Introduction

These Terms and Conditions ("Terms") govern your use of the services provided by SysTek Limited ("we," "our," "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue using our services.

Definitions

  • "Client" refers to any individual, business, or entity that registers or utilizes our services.
  • "Services" refer to domain hosting, website hosting, email hosting, and related IT solutions provided by SysTek Limited.
  • "User Data" refers to any data submitted, stored, or transmitted by clients within our services.

1. Services Provided

SysTek Limited offers domain registration, web hosting, email hosting, and technical support services. These services are subject to availability, and we reserve the right to modify or discontinue any service at our discretion.

2. Account Registration & Responsibilities

  1. Clients must provide accurate and complete information when registering for our services.
  2. Clients are responsible for maintaining the confidentiality of their account credentials.
  3. Unauthorized access or use of another client's account is prohibited.

3. Data Protection & Privacy

  1. SysTek Limited adheres to the National Data Governance and Protection Policy (NDGPP) of Papua New Guinea.
  2. We collect and store client information strictly for service provision and operational improvements.
  3. We do not share personal data with third parties unless required by law.
  4. Clients retain control over their data and may request access, modifications, or deletion of their data as per our Privacy Policy.

4. Service Availability & Uptime

  1. SysTek Limited aims to provide 99.9% uptime for hosting services, but we do not guarantee uninterrupted service.
  2. Scheduled maintenance may cause temporary downtime, and we will notify clients in advance whenever possible.
  3. We are not liable for downtime caused by third-party providers or unforeseen circumstances such as cyber-attacks, natural disasters, or infrastructure failures.

5. Acceptable Use Policy

  1. Clients may not use our services for illegal or unethical activities, including but not limited to:
    • Hosting or distributing malware, viruses, or phishing sites.
    • Sending unsolicited bulk emails (spam).
    • Hosting illegal content, including pirated software or copyrighted material without proper authorization.
  2. SysTek Limited reserves the right to suspend or terminate accounts found in violation of this policy.

6. Payment Terms

  1. Clients agree to pay service fees as outlined in their billing agreement.
  2. Invoices must be settled by the due date specified. Failure to pay may result in service suspension.
  3. Refunds are issued at the discretion of SysTek Limited based on service interruptions or billing errors.

7. Data Backup & Security

  1. SysTek Limited implements containerized hosting and automated encrypted backups.
  2. Clients are responsible for maintaining their own backups in addition to our provided backup services.
  3. In the event of a data breach, SysTek Limited follows NDGPP breach response protocols, including client notification and remediation measures.

8. Termination & Suspension

  1. Clients may terminate their services by providing written notice.
  2. SysTek Limited may suspend or terminate services if:
    • A client violates these Terms.
    • Payment obligations are not met.
    • Required by law or regulatory authorities.
  3. Upon termination, all hosted data is permanently removed unless otherwise requested.

9. Liability & Disclaimer

  1. SysTek Limited is not liable for any loss of data, business disruptions, or damages arising from the use of our services.
  2. We provide services "as is" without warranties of any kind.
  3. Clients use our services at their own risk and agree to indemnify SysTek Limited against claims arising from misuse.

10. Modifications to Terms

SysTek Limited reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Papua New Guinea. Any disputes shall be resolved in the jurisdiction of Port Moresby, Papua New Guinea.
